NestCoverage Terms of Use

These Terms of Use ("Terms") govern your access to and use of
the NestCoverage website, services, forms, and content
(collectively, the "Service"). By accessing or using the Service,
you agree to be bound by these Terms. If you do not agree, do
not use the Service.
1. NATURE OF SERVICE
NestCoverage is an independent marketing and referral service
that connects consumers with licensed insurance agents, brokers,
carriers, call centers, and marketing partners. NestCoverage
is NOT an insurance company, agent, broker, or carrier. We do
not underwrite, issue, sell, or guarantee insurance products.
Any insurance policies, premiums, or quotes are provided by
licensed third parties.
2. NO PROFESSIONAL ADVICE
The information provided through the Service is for general
informational purposes only. It does not constitute insurance,
legal, financial, or tax advice. You should consult a qualified
licensed professional regarding your individual situation before
making any insurance or financial decisions.
3. ELIGIBILITY
To use the Service you must:
- Be at least 18 years of age
- Be a resident of the United States
- Be legally able to enter into binding agreements
- Provide truthful and accurate information
4. USER SUBMISSIONS
By submitting information through the Service, you represent
and warrant that:
- The information you provide is true, current, and accurate
- You are providing your own information or are authorized to
provide it
- You consent to receiving communications from NestCoverage and
our marketing partners as described in our TCPA Disclosure
- You authorize us to share your information with licensed
insurance agents, brokers, carriers, call centers, and
marketing partners
5. NO GUARANTEE OF RESULTS
NestCoverage does not guarantee:
- That you will receive insurance quotes
- That you will qualify for any insurance product
- That any specific premium, coverage, or provider will be
available to you
- That any provider listed or referred will contact you
- That any product offered will be the best or lowest-cost
option for your needs
- The accuracy, timeliness, or availability of any quote or
provider information
6. INSURANCE PRODUCT DISCLAIMERS
Insurance availability, pricing, terms, and approval are
determined solely by the insurance carrier and applicable
underwriting. Coverage availability varies by state. Not all
products are available in all states. Insurance products are
subject to medical underwriting, application approval, and
state-specific regulations.
7. INTELLECTUAL PROPERTY
All content on the Service, including text, graphics, logos,
trademarks, design elements, and software, is owned by or
licensed to NestCoverage and is protected by intellectual
property laws. You may not copy, reproduce, modify, distribute,
or create derivative works without our prior written permission.
8. PROHIBITED CONDUCT
You agree not to:
- Submit false, inaccurate, or misleading information
- Submit information about another person without authorization
- Interfere with or disrupt the Service or its security features
- Use automated means (bots, scrapers, etc.) to access the Service
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable law or regulation
9. THIRD-PARTY PROVIDERS
The Service connects you with third-party insurance agents,
brokers, carriers, call centers, and marketing partners. Any
relationship, transaction, or communication between you and
these third parties is solely between you and them. NestCoverage
is not a party to those interactions and is not responsible for
the products, services, conduct, or communications of third
parties.
10. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT
LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED,
ERROR-FREE, OR SECURE.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NESTCOVERAGE
AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES
SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT
NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL,
ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY
THIRD-PARTY PRODUCT OR SERVICE OBTAINED THROUGH THE SERVICE,
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS
OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
12. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless NestCoverage
and its owners, officers, employees, contractors, and affiliates
from any claims, liabilities, damages, losses, and expenses
(including reasonable attorneys' fees) arising out of or related
to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law
- Your submission of false or misleading information
- Your interaction with any third-party provider
13. PRIVACY
Your use of the Service is also governed by our Privacy Policy,
which is incorporated into these Terms by reference.
14. DISPUTE RESOLUTION
Any dispute arising out of or relating to these Terms or the
Service shall be resolved through good faith negotiation. If
negotiation fails, disputes shall be resolved in accordance
with applicable law of the jurisdiction in which the dispute
arises.
15. CHANGES TO TERMS
We may update these Terms from time to time. Material changes
will be posted on this page with a revised effective date. Your
continued use of the Service after changes are posted constitutes
acceptance of the updated Terms.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable,
the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and TCPA Disclosure,
constitute the entire agreement between you and NestCoverage
regarding your use of the Service.
